Transfer of Council Permits and Registrations

Transfer of council permits and registrations requires a Section 173 Agreement, a contract between the council and the landowner. It must be agreed upon and entered into for all council permits and registrations. This agreement is legally binding and applies to all current and future landowners until the specified end date. Before completing a transfer, it is wise to consult a lawyer to review the document and ensure you understand the terms.

Melbourne Council Permits and Registration Lawyers

Hughes Legal are contract law experts working across the breadth of legal specialisations related to sales and purchases, with a niche specialisation in council permits and registrations. We advise clients on their rights and assist with drafting and negotiating the terms of the agreement, including the review process with VCAT, where necessary.

If you wish to change the 173 Agreement, all parties — the council and landowner — need to consent to the changes. We can assist with this process and help you understand the various processes required to do this, depending on the council. Where agreements cannot be made, we can help you seek a review of the decision through VCAT.
