Probate

If a person has been appointed as Executor in a will, then it is a requirement that they obtain a grant of probate. A grant of probate is obtained from the Supreme Court of Victoria and is a legal authority which proves a will to be valid and enables the person named as executor to administer the estate and distribute the estates assets to those beneficiaries named in the will.

Alternatively, if a person dies without a Will then who receives the estate is determined in accordance with the law and in such cases, letters of administration are required from the Supreme Court. Letters of Administration authorise a person to administer the estate and distribute the assets of the estate.

Deceased Estates

Hughes Legal understands that the death of a loved one can be a stressful and emotional time for all involved. We can guide you through the process of administering the Estate, providing the necessary advice and assistance to ensure it is as stress-free as possible.

The role of an Executor is an important one, whereby the person acts as the legal representative of the deceased. Once a grant of probate has been obtained, the Executor is able to legally act on behalf of the deceased and carry out their wishes in accordance with the Will.

With the role comes a number of important duties and obligations, including:

  • Arranging burial or cremation of the body
  • Collect all debts that are due to the estate
  • Collecting and taking control of all the deceased assets
  • Using the deceased assets to pay off all of the deceased debts
  • To distribute the deceased assets in accordance with the Will

  • Identifying and collecting the deceased’s assets
  • Identifying and paying off all debts of the Estate
  • Advice about the tax liability of the Deceased
  • Advice and assistance with distributing the assets of the Estate
