Probate
If a person has been appointed as Executor in a will, then it is a requirement that they obtain a grant of probate. A grant of probate is obtained from the Supreme Court of Victoria and is a legal authority which proves a will to be valid and enables the person named as executor to administer the estate and distribute the estates assets to those beneficiaries named in the will.
Alternatively, if a person dies without a Will then who receives the estate is determined in accordance with the law and in such cases, letters of administration are required from the Supreme Court. Letters of Administration authorise a person to administer the estate and distribute the assets of the estate.

- Collect all debts that are due to the estate
- Collecting and taking control of all the deceased assets
- Using the deceased assets to pay off all of the deceased debts
- To distribute the deceased assets in accordance with the Will
